SmartPens4u Limited Warranty

This Limited Warranty (“Warranty”) applies to the SmartPens4u RocketPen pen scanner (“Product”) purchased by you (“Customer”).

Warranty Coverage:

SmartPens4u Corporation (“SmartPens4u”) warrants the Product to be free from defects in materials and workmanship for a period of 1 year from the date of original purchase (“Warranty Period”). This Warranty covers only the Product itself and does not extend to any accessories or other items used with the Product.

What We Will Do:

If a defect covered by this Warranty arises during the Warranty Period, SmartPens4u will, at its sole discretion, either:

• Repair the Product using new or refurbished parts,
• Replace the Product with a new or refurbished product of the same or similar model, or
• Issue a refund of the original purchase price of the Product.

What is Not Covered:

This Warranty does not cover:

• Defects caused by normal wear and tear,
• Defects caused by misuse, abuse, neglect, accident, alteration, modification, or unauthorized repair,
• Defects caused by use with incompatible accessories,
• Defects caused by operation outside the intended use or specifications for the Product,
• Acts of God, such as lightning, flood, or earthquake.

(Lithium Battery is a component that has a limited lifetime and is subject to wear and tear even if maintained properly.)

Customer Obligations:

To obtain warranty service, you must:

• Provide a copy of your dated proof of purchase,
• Contact SmartPens4u Customer Support at support@smartpens4u.com to obtain a Return Merchandise Authorization (“RMA”) number, and
• Return the defective Product to SmartPens4u, freight prepaid, in its original packaging or packaging providing an equivalent level of protection.

Disclaimer of Warranties:

THIS WARRANTY IS THE EXCLUSIVE WARRANTY PROVIDED BY SMARTPENS4U AND SUPERSEDES ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM SMARTPENS4U OR ITS REPRESENTATIVES SHALL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.

Limitation of Liability:

SMARTPENS4U SHALL NOT BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR THE INABILITY TO USE THE PRODUCT, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER THEORY OF LIABILITY, AND EVEN IF SMARTPENS4U HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION SHALL APPLY TO THE EXTENT PERMITTED BY LAW.

Governing Law:

This Warranty shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of laws provisions.

Entire Agreement:

This Warranty constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.
